Terms & Conditions – Banana Edit

Welcome to Banana Edit, Made by GMint Apps, A brand of GINMINT TECH. OPC PVT. LTD (“We”). These Terms & Conditions govern your use of our mobile application (the “App”). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please stop using the App immediately.

Prohibited Content

You agree not to upload, create, or share any content through Banana Edit that is unlawful, harmful, or otherwise restricted. This includes, but is not limited to:

• Any content involving or depicting minors (except non-human content such as pets, landscapes, or objects).
• Nudity, sexually explicit, pornographic, or sexually suggestive material.
• Content that promotes violence, harassment, hate speech, discrimination, or abuse.
• Content that violates laws, regulations, or platform rules, including those of the Apple App Store or Google Play Store.
• Content that infringes upon or misuses the rights of others, including copyright, trademark, privacy, or publicity rights.
• Fraudulent, misleading, defamatory, libelous, or malicious material.
• Malware, harmful code, or any attempt to disrupt the service.

We reserve the right to review, remove, and report prohibited or illegal content, and to suspend or terminate accounts that violate these rules.

Consent

By uploading or generating content through the App, you confirm and represent that:

• You own or have secured all necessary rights, licenses, and permissions for any uploaded content.
• You have obtained consent from any identifiable individuals depicted in your content.
• You authorize Banana Edit and its partners to process, host, and store content for the sole purpose of operating and improving the App.

You are fully responsible for obtaining and maintaining all consents and permissions related to your content.

Content and Intellectual Property

• Your Content: You retain ownership of all content you upload or generate. You may use your content for any lawful purpose, including personal and commercial uses. However, you are solely responsible for ensuring that your use complies with all applicable laws and does not infringe on the rights of others. By uploading content, you grant us and our partners a limited, non-exclusive license to process and store it only as needed to provide the App’s services.

• Our Content: All software, features, branding, and designs of the App are the property of Banana Edit and its licensors. You may not copy, modify, reverse-engineer, or redistribute any part of the App without prior written permission.

AI-Generated Content

The App uses artificial intelligence to generate or modify content based on your inputs. You acknowledge and agree that:

• AI outputs may be unique, unexpected, or vary in quality.
• You retain ownership of outputs you generate and may use them for personal or commercial purposes.
• You are solely responsible for how you use, publish, or distribute AI-generated content. This includes any legal, ethical, or regulatory consequences that may arise.
• Banana Edit makes no guarantees about originality, copyright status, or suitability of AI outputs for any particular use.

Limitation of Liability

• You use the App at your own risk. We do not guarantee uninterrupted operation, error-free outputs, or results that meet your expectations.

• Banana Edit is not responsible for any claims, damages, or disputes arising from:

  • Content you upload or create,
  • The use, publication, or distribution of AI-generated outputs,
  • Violations of third-party rights,
  • Any illegal or prohibited use of the App.

• No refunds are offered. From time to time, we may provide free credits for demo or promotional purposes, at our sole discretion.

• Banana Edit, its developers, partners, and affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to loss of data, loss of profits, or legal claims arising out of or related to your use of the App, your content, or AI-generated content.

• By using the App, you agree that Banana Edit provides the service “as is” and makes no warranties of any kind, whether express or implied.

Content Moderation and Enforcement

We reserve the right, but are not obligated, to monitor, review, and moderate content uploaded or generated through the App. This may include automated tools and/or human review.

We may, at our sole discretion:

• Remove or restrict access to any content that violates these Terms, App Store policies, or applicable law.

• Suspend or terminate accounts that engage in prohibited or abusive behavior.

• Report illegal content to the App Store, relevant authorities, or law enforcement if required.

• You acknowledge that moderation cannot guarantee prevention of all prohibited content, and you remain solely responsible for the material you upload, create, or distribute through the App.

Subscription and Payments

Some features of Banana Edit may be offered for free, while others may require a paid subscription or in-app purchase.

All payments are processed through the Apple App Store or Google Play Store and are subject to their respective terms and policies.

Subscriptions automatically renew unless canceled through your App Store account settings before the renewal date.

We do not offer refunds for purchases or subscriptions. At our discretion, we may provide free credits or trial access for demonstration or promotional purposes.

We reserve the right to change subscription pricing, tiers, or included features at any time.

Indemnification

You agree to defend, indemnify, and hold harmless Banana Edit, its developers, partners, and affiliates from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising from:

• Your use of the App or AI-generated content,

• Content you upload, create, or distribute,

• Any violation of these Terms,

• Any infringement of third-party rights, including intellectual property, privacy, or publicity rights.

Changes to Service and Features

We may update, modify, or discontinue parts of the App at any time. This includes adjusting what is available under free credits or paid subscription tiers. We reserve the right to change pricing, features, or functionality without prior notice.

Termination

We may suspend or terminate your account or access to the App if you violate these Terms, upload prohibited content, or otherwise misuse the service. Termination does not affect our rights regarding previously uploaded or generated content.

Governing Law

These Terms are governed by and construed under the laws of the United States of America, without regard to conflict of law principles.
